The petitioner is in judicial custody in connection with Khanpur P.S. Case No. 135 of 2021, registered under Sections 366/34 of the Indian Penal Code.

Allegation against the petitioner and other accused persons are of kidnapping the sister of the informant and later on demand of Rs. 10,000/- for her release.

From perusal of learned Sessions Judge order, it shows that subsequently the victim girl was recovered and she made statement under Section 164 Cr.P.C. wherein she specifically named this petitioner who forcefully made physical relationship with her inside the room while three other accused persons were guarding the room.

Patna High Court CR. MISC. No.63349 of 2021(3) dt.25-04-2022 2/2 Taking into account the aforesaid facts that specific allegation has been made against this petitioner, this Court is not inclined to grant the privilege of bail to the petitioner herein, which is accordingly rejected.
