JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,447,341,307,448,379 and 504 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged against the petitioner that he caused fire arm injury on the thigh of the informant.

It is submitted by the learned counsel for the petitioner that the injury report reflects one penetrating injury caused by hard and blunt substance simple in nature on the right thigh of the informant whereas the other injury has been found to be fracture of right elbow - upper end of radius. It is further submitted that the said injury has been caused by other accused persons who

Patna High Court Cr.Misc. No.36940 of 2015 (2) dt.11-09-2015 2/2 have been granted bail by the learned court below. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the accusation being not corroborated with the medical opinion, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Muzaffarpur in connection with Kurhani P.S. Case No.184 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
