ANJANA MISHRA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 467/468/471/420 and 120(B)/34 of the Indian Penal Code. The allegation against the petitioner is that he was appointed as a Prakhand Teacher on the basis of the certificate issued by an institution which is said to be fake. It is further submitted that in pursuance of an order passed in a Public Interest Litigation by this Court, certain enquiries were made in which the petitioner's certificate was found to be from a fake institution and as such, the present First Information Report has been lodged. Learned counsel for the petitioner further submits that other similar situated persons have been granted anticipatory bail by several Benches of this

Patna High Court Cr.Misc. No.32168 of 2016 (3) dt.11-08-2016 P2/2 Court in Cr. Misc. Nos. 14229 of 2016, 18272 of 2016, 16528 of 2016 and 17523 of 2016 vide order dated 01.04.2016, 02.05.2016, 12.05.2016 and 29.06.2016 respectively.

Considering the aforementioned facts and circumstances and that the similarly situated persons have already been granted bail, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 18/16, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
