The petitioner apprehends his arrest in Kasim Bazar P.S. Case No. 59/2016 registered under Section 47(A) of the Bihar Excise Act, 2016.

On Secret information, a raid was conducted at the grocery shop of the petitioner and from the possession of the petitioner 11⁄2 litres of country made foreign liquor was recovered. It is submitted that the recovered wine is small quantity. It is submitted that no offence under Section 47(A) of the Excise Act, 2016 is made out as the same is applicable against the company.
