The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code and 138 of N.I. Act. It is alleged that the petitioner bring proprietor of M/s. Sadhana Rice Mill, Bikrampur, Patna issued cheque of Rs.5,00,000/- in favour of BSFC, Madhubani against the outstanding due amount but the said cheque got bounced. It is submitted by learned counsel for the petitioner that now the petitioner has already deposited the said
Patna High Court Cr.Misc. No.35919 of 2015 (2) dt.04-09-2015 2/2 amount.
This contention of learned counsel for the petitioner has not been controverted by Mr. Shailendra Kumar Singh, learned counsel for BSFC.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Madhubani Nagar P.S. Case No. 397 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
