2. In this case, the petitioner is seeking regular bail in connection with Kankarbagh P.S. Case No. 166 of 2025, registered for the offences punishable under Sections 109, 191(2), 191(3), 190, 132, 351(2), 352 of BNS and section 27 of Arms Act. Later on, section 25(1-b)a, 26, 35 of Arms Act was added.

3. According to prosecution case, ASI Neeraj Kumar received information that some miscreants were firing due to land dispute and were hatching conspiracy at the petitioner's house. The police party reached at the spot and surrounded the house of the petitioner upon which the accused persons started firing on police personnel, with intention to kill them. In the meantime, several accused persons managed to escape while two of them were

Patna High Court CR. MISC. No.56794 of 2025(2) dt.12-08-2025 2/2 apprehended. The apprehended persons disclosed their names as Suraj Kumar @ Guddu and Tinku @ Ashish.

4. The learned senior counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. The petitioner was not arrested at the spot. Nothing was recovered from his possession. There is allegation that the petitioner and co-accused Dayanand Kumar started firing, but none has suffered any kind of firearm injury. The petitioner is under custody since 18-03-2025.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Patna in connection with Kankarbagh P.S. Case No. 166 of 2025, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
