The Petitioner seeks bail in Sessions Trial No. 214 of 2014 arising out of Begusarai Town P.S. Case No. 377 of 2013 instituted for the offences under Sections 302/34 of the Indian Penal Code as also Section 27 of the Arms Act pending before the Court of learned District & Sessions Judge, Begusarai. Considering the nature of allegation against the Petitioner that he had committed this act while on bail, I am not inclined to release him from jail custody and hence, the prayer for bail is rejected.
The Trial Court is directed to expedite the trial and for which reason it shall send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of
Patna High Court Cr.Misc. No.35633 of 2014 (3) dt.27-01-2015 this order, to the Superintendent of Police, Begusarai, and the Superintendent of Police, Begusarai is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
