The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 506/34 of the Indian Penal Code.

The prosecution case is that petitioner and others were running Ashoka Maritime Academy for providing training and facilitating employment in Maritime. The further case of the informant is that the informant and others paid Rs. 1,45,000/- for the purpose of training as well as employment. Subsequently, Rs. 2,00,000/- were also paid to the petitioner but neither the job was provided nor the money was returned to the informant.

Patna High Court Cr.Misc. No.37929 of 2015 (2) dt.18-09-2015 It is submitted by the learned counsel for the petitioner that the petitioner was running the Ashoka Maritime Academy duly incorporated under the Companies Act, which used to impart training for purposes of career development, job placement, teachers training, preparation for the academic and professional examination conducted by various Government, Semi-government and Non-government sector for the purpose of employment in Marine or Ship. There is no proof of payment as alleged but the fee was charged for providing training which was provided to the informant's side.

Considering the nature of accusation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur in connection with Danapur P.S. Case No. 193 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
