====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 20-07-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State through video conferencing.

The petitioner has filed the instant application for grant of regular bail in connection with Barachatti P.S. Case no. 484 of 2019 registered under section 395 of the Indian Penal Code against five unknown persons.

As per allegation in the FIR, five accused persons on three motor-cycles surrounded the informant and on the point of pistol dispossessed him of his laptop and Rs. 80,000/ in cash besides other articles as mentioned in the FIR. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. His name transpired in course of investigation on the basis of the

No incriminating material has been recovered from his possession and inspite of being in custody since 3.12.2019 and investigation in the case having concluded, he has not been put on T.I. Parade. The reason for his false implication is his antecedents.

The application for bail is opposed by learned Additional Public Prosecutor for the State who submits that the petitioner is accused in twelve other cases.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the submissions made on behalf of the petitioner together with the petitioner having remained in custody for 1 year 7 months, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Barachatti P.S. Case no. 484 of 2019 on furnishing bail bond of Rs. 10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sheraghati, Gaya.
