The petitioner being husband of the victim is languishing in custody since 09.09.2013 in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Accusation is of killing the daughter of the informant after one month of the marriage for non-fulfilment of the dowry demand.
It is submitted by the learned counsel for the petitioner that the victim died natural death but the inquest and the post-mortem report reflect ligature mark suggesting mark of violence.
Patna High Court Cr.Misc. No.36258 of 2014 (3) dt.13-01-2015 Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner in connection with Ramgarh P.S. Case No. 127 of 2013 pending in the Court of learned Chief Judicial Magistrate, Kaimur at Bhabhua.
