Petitioner seeks bail in Sursand P.S. Case No. 25 of 2018 instituted for the offence under Section(s) 324, 307, 302/34 of the Indian Penal Code.

It is alleged in the written report that on the date of occurrence while the informant was in Mahashivratri Fair, 1 to 2 boys arrived and informed him that his brother Manish Kumar and cousin Chandan Kumar were assaulted by Munna Thakur of village Narha along with 8 to 10 persons. The informant went there and saw his brother was assaulted by Munna Thakur and others. It is further alleged that co-accused Aditya Kumar @ Belna and Raushan Kumar were assaulting his

Patna High Court Cr.Misc. No.72017 of 2018(2) dt.05-12-2018 2/2 brother with knife and other associates were assaulting the cousin of informant, namely, Chandan Kumar. On alarm, accused persons fled away. It is alleged that in the way of hospital, brother of informant told that Munna Thakur had got him injured. Subsequently brother of informant died. From the written report, it appears that there is no any injury found on the person of cousin brother of informant. Petitioner is in custody since 10.09.2018 In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Pupri, Sitamarhi in connection with Sursand P.S. Case No. 25 of 2018 subject to the condition that both the bailors shall be close relative of the petitioner.
