The petitioner seeks regular bail in connection with S.Tr. No.297 of 2018 arising out of Kargahar P.S.Case No.154 of 2017 dated 3.6.2017 registered for offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 25(1-b)a, 26, 27 of the Arms Act.
Allegation against the petitioner is of firing on the deceased and his prayer for bail was earlier rejected by the then Co-ordinate Bench of this Court vide order dated 10.4.2018 passe din Cr. Misc. No.20748 of 2018.
Submission of the learned counsel for the petitioner is that now the charge has been framed and the petitioner is in custody for more than 1 1⁄2 year.
Patna High Court Cr.Misc. No.71690 of 2018(2) dt.12-12-2018 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail the petitioner, however, the learned trial court is directed to expedite the trial.
With the aforesaid observation, this application is dismissed.
