The petitioner is languishing in custody for the offences punishable under Sections 341, 323, 376 of the I.P.C. The victim has levelled allegation against the petitioner of commission of rape. The aforesaid allegation is there in the FIR as well as in the statement under Section 164 Cr.P.C.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail. Hence, prayer for bail is refused in connection with Kursela P.S. Case No. 15 of 2020 pending in the court of learned Chief Judicial Magistrate, Katihar.
