JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498A, 341, 342, 323, 307, 324, 504, 506/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.
Petitioner no. 1 is Nanad whereas petitioner no. 2 is Dewar and petitioner no. 3 is mother-in-law of the informant. The written report of the informant reflects that the entire allegations of torture as well as illegal demand centers around against the husband of the informant.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.73418 of 2018(2) dt.20-12-2018 2/2 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in Paharpur( Mahila) P.S Case No. 118 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
