JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Petitioners are languishing in custody since 05.05.2014 in a case registered for the offences punishable under Sections 395, 397 of the I.P.C.

Accusation is committing dacoity in the house of the informant.

It is submitted by learned counsel for the petitioners that neither any recovery has been made from either

Patna High Court Cr.Misc. No.34162 of 2014 (3) dt.09-02-2015 2/2 of the petitioner nor they have been put on test identification parade. The statements to that effect have been made in para 8 and 10 of each of the petition. Though petitioners are accused in one other case apart from the present one. It is further submitted that other co-accused has been granted bail vide Cr. Misc. No. 35436 of 2014.

Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S. Case No. 42 of 2014.
