The petitioner seeks regular bail in connection with Kotwali (Tilkamanjhi) P.S.Case No.471 of 2018 registered for offences punishable under Sections 379, 411, 413, 414 of the Indian Penal Code.
Allegation against the petitioner is about recovery of stolen motorcycle from the Garage of the petitioner. Submission of the learned counsel for the petitioner is that there is no case with regard to theft of the motorcycle and the petitioner has no criminal antecedent and he is in custody since 21.7.2018 and another co-accused having similar allegation has been granted bail by the Co-ordinate Bench of this Court, vide order dated 29.10.2018 passed in Cr. Misc.
Patna High Court Cr.Misc. No.71604 of 2018(2) dt.10-12-2018 2/2 No.63910 of 2018.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S.Case no.471 of 2018..
With the aforesaid observation, this application is allowed.
