The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 2, 33, 41 and 42 of the Indian Forest Act, 1927 and 2, 27, 29, 31 and 51 of the Wildlife Protection Act, 1972.

According to the complainant, the wooden logs of illegally felled trees were recovered from the Commander jeep in forest area.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He

Patna High Court CR. MISC. No.63313 of 2021(2) dt.18-05-2022 2/2 further submits that the petitioners have not been arrested at the spot and no wooden logs were recovered from the conscious or constructive possession of the petitioners.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Raj Kapoor, Judicial Magistrate, Ist Class, Bettiah, West Champaran in connection with Trial No.1849 of 2021 arising out of Forest Case No.13F of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
