JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

It is alleged that on the telephonic direction of the petitioner, in the background of business relationship between the petitioner and the informant, the informant sent on telephonic instruction 350 quintals and 360 quintals of wheat seed through two trucks respectively on 26.11.2014 and 02.12.2014, worth Rs.15,50,000/-, but on repeated request, the payment has not been made against the supply.

It is submitted by learned counsel for the petitioner that the accusation is based only on oral direction through mobile and the mobile through which the order was given does not belong to

Considering the nature of accusation arising out of business transaction, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No.220 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
