The petitioner apprehends his arrest in Maharajganj P.S. Case No. 137 of 2021, registered for the offences punishable under Sections 307, 323, 379 and other allied sections of the Indian Penal Code.

Prosecution case in brief is that on the alleged date and time of occurrence, while the informant was returning him home and reached near Chaurasi Nath Mandir he saw this petitioner and four unknown persons who were consuming liquor. All the accused persons surrounded hims and took Rs. 20,000/- from his possession. When informant raised alarm, one of them assaulted him by country made pistol on his head, nose and thereafter, fled away.

There is general and omnibus allegation and no specific overt act has been alleged against this petitioner. Allegation of snatching cash is ornamental. Both parties have compromised the matter and a joint compromise petition has been filed through e-mail. Petitioner has got clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Siwan in connection with Maharajganj P.S. Case No. 137 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
