Petitioner apprehends his arrest in connection with Noorsarai P.S. Case No. 95 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504 of the Indian Penal Code and Section 27 of Arms Act. On behalf of petitioner it is submitted that the petitioner has been implicated in a false case, there is case and counter case, as per first information report of this case, the petitioner is an order giver only and further the injury found on the person of the informant is simple in nature vide annexure-2 and as such the petitioner deserves sympathetic consideration to which learned APP does not dispute.
In the facts and circumstances stated above, the
Patna High Court Cr.Misc. No.33540 of 2016 (2) dt.20-08-2016 petitioner above named, in case of his surrender or arrest within one month from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Noorsarai P.S. Case No. 95 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
