2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 21(b) and 22 of the NDPS Act, 1985, registered in connection with Ishakchak P.S.Case No. 73 of 2024.

3. As per allegation, on a tip-off, the police party intercepted a car in which the petitioner along with others were found sitting and 100 gms of brown sugar, a mobile phone and cash of Rs.2200/- were recovered in the process.

4. The learned counsel for the petitioner has submitted that the petitioner in incarcerating in prison due to false implication and nothing incriminating has been recovered

Patna High Court CR. MISC. No.55424 of 2024(2) dt.02-08-2024 2/2 from his possession. It is further submitted that similarly situated co-accused Md. Yasin has been granted bail by this Court under order dated 09.07.2024 passed in Cr. Misc. No.46711 of 2024, vide Annexure-2.

Considering the above facts and circumstances as well as bearing in mind the doctrine of parity, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge Bhagalpur in connection with Ischakchak P.S.Case No. 73 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
