ANJANA MISHRA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners being co-villagers apprehend their arrest in connection with a case registered for the offences punishable under Sections 304(B), 120(B)/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the provisions of Section 304(B) of the Indian Penal Code will not be attracted in case of a person who is not a family member. It is further submitted that in course investigation, the final form has now been submitted and the petitioners have not been chargesheeted.

Considering the aforementioned fact and circumstances, let the petitioners above named, in the event of their arrest / surrender

Patna High Court Cr.Misc. No.27618 of 2016 (2) dt.17-09-2016 P2/2 within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Kathaiya P.S. Case No. 40/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
