The petitioners seek bail in anticipation of their arrest in connection with Bahadurganj P.S. Case No. 149 of 2020, dated 02.06.2020, instituted for the offences under Sections 341, 323, 307, 354, 506 and 34 of the Indian Penal Code.

Though several allegations have been levelled

No.11161 of 2021(2) dt.25-02-2022 2/3 against the petitioners who are brothers amongst themselves, but it has been submitted on their behalf that the informant is a close relative of the petitioners and the dispute arose because of the apportionment of some landed property belonging to the joint family property. It has further been submitted that the dispute has already been settled and the parties do not wish to prosecute each other in any criminal case whatsoever.

The aforesaid statement has been borne out from paragraph 10 of the bail petition.

Regard being had to the facts afore-stated and taking into account that the informant does not wish to prosecute the petitioners any further, they (the petitioners), in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate I/C, Kishanganj in connection with Bahadurganj P.S. Case No. 149 of 2020, subject to the

Patna High Court CR. MISC. No.11161 of 2021(2) dt.25-02-2022 3/3 conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
