ANJANA MISHRA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner being the Mukhiya is apprehending her arrest in connection with Kurhani P.S. Case No. 449 of 2015 registered for the offences punishable under Sections 420, 406 and 409 of the Indian Penal Code.
Counsel for the petitioner submits that the allegation against the petitioner is that she as a Mukhiya had participated in the embezzlement of Government money, inasmuch as money which was meant for being paid to the labourer for executing MNREGA scheme was instead used for the payment of the fictitious daily wage labourers. Patna High Court Cr.Misc. No.32413 of 2016 (2) dt.25-11-2016 submits that a high level committee was constituted to make an inquiry of the matter and after due inquiry found the petitioner to be innocent and the report indicates that she had no role to play in the same. In support of the same he has filed Annexure-2. Considering the nature of allegations made and the report which is Annexure-2, let the above named petitioner, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Manish Pandey, Judicial Magistrate1st Class, Muzaffarpur in connection with Kurhani P.S. Case No.449 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
