The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 147, 341, 323, 324, 325, 307, 379, 427, 448, 504 of the Indian Penal Code. The prosecution case in nutshell is that petitioner along with other co-accused persons, variously armed, came to the house of informant and started abusing and assaulting the informant. When the family members of the informant came to her rescue, they were also assaulted. Allegation against the petitioner is
Patna High Court CR. MISC. No.53040 of 2022(2) dt.14-02-2023 2/3 that he along with co-accused Mangal Mahaldar assaulted one Anirudh Kumar by means of iron rod due to which he sustained head injuries.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case due to village politics. There is case and counter case between the parties and both parties have sustained injuries as alleged in separate occurrence. A compromise petition has been filed between the parties. Moreover, the petitioner is languishing in judicial custody since 6.6.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named
