JUSTICE SANJAY PRIYA ORAL ORDER 31-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 341, 323, 452, 354(A), 354(B), 366(A), 511, 504, 506 and 34 of the Indian Penal Code. It has been submitted that there is no allegation of overt act against the petitioner.

The learned A.P.P. has opposed the prayer for anticipatory bail.

It is alleged in the written report that Mukhiya Ajay Kumar with some anti social elements entered in the house with intention to kidnap the minor daughter of the informant and also teased her. It is further alleged that Ajay Kumar arrived again in the house with the petitioner and other accused persons and

Patna High Court Cr.Misc. No.3098 of 2017 (2) dt.31-01-2017 2/2 assaulted the elder brother of the informant. In this manner from the written report itself, it appears that no allegation of any specific overt act has been levelled against the petitioner.

In such circumstances, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Shakurabad P.S. Case No. 102 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar Singh, A.D.J. 1st, Jehanabad, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
