18-08-2015 Heard Sri Uma Shankar Singh, learned counsel for the petitioner and learned A.C. to Standing Counsel - 2. The petitioner, invoking writ jurisdiction of this Court, has prayed for directing the respondent no. 2 i.e. District Magistrate-cum-Appellate Authority, Rohtas under the Forest Act to dispose of Forest Appeal No. 21 of 2015. In the writ petition, a prayer has also been made for directing for the provisional release of seized vehicle, bearing registration no. UP60T/3033, however; at the time of argument, learned counsel for the petitioner confined his prayer to the extent of direction for disposal of the appeal. In view of limited prayer made by learned counsel for the petitioner, without calling for counter affidavit, the Court considers that writ petition can be disposed of.

Patna High Court CWJC No.12510 of 2015 (2) dt.18-08-2015 2/2 Accordingly, the writ petition stands disposed of with an observation that learned appellate authority i.e. respondent no. 2/District Magistrate, Rohtas may take appropriate step so that the appeal i.e. Forest Appeal No. 21 of 2015 may be disposed of, preferably; within a period of four months from the date of receipt/production of a copy of this order.
