The petitioner seeks regular bail in connection with Minapur P.S.Case No.98 of 2018 registered for offences punishable under Sections 414/34 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.
Earlier the prayer for bail of the petitioner was rejected vide order dated 12.7.2018 passed in Cr. Misc. No.41944 of 2018 and the allegation is of recovery of one country-made pistol with one live cartridge , however it appears that he is accused in seven other cases.
Submission of the learned counsel for the petitioner is that the petitioner is now in custody for more than nine months and he is ready to abide by any condition imposed upon him.
Patna High Court Cr.Misc. No.73907 of 2018(2) dt.17-12-2018 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, at this stage I am not inclined to grant bail tot he petitioner however, once the charge is framed int his case, the petitioner is at liberty to renew his prayer for bail.
With the aforesaid observation, this application is dismissed.
