The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 353, 504, 506 of the Indian Penal Code. It is a case of obstruction in official duty of the police personnel. It is alleged that the petitioner along with co-accused persons tried to assault the police party and shot fire upon them.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and he has falsely been implicated in the present case. There is no specific allegation against the petitioner and the allegation levelled

Patna High Court CR. MISC. No.36111 of 2022(2) dt.29-11-2022 2/2 against the petitioner is that he was a member of mob. It is also submitted that similarly situated co-accused persons have been granted bail vide order dated 11.04.2022 and 25.04.2022 passed in Cr. Misc. No. 42412 of 2021 and 48702 of 2021 respectively.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nawada in connection with Roh P.S. Case No. 132 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) nirajkrs/- U T
