ANJANA MISHRA ORAL ORDER 08-11-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Mohania P.S. Case No.255 of 2016 for allegedly having committed the offences under Sections 147, 148, 149, 307, 323, 324, 379 and 504 of the Indian Penal Code. Learned counsel for the petitioners submits that there is a case and counter case between the parties in which both the parties have received injuries. The injuries are said to have been simple in nature. Learned counsel for the petitioners further points out to an order dated 28.09.2016 passed in

Patna High Court Cr.Misc. No.32383 of 2016 (4) dt.08-11-2016 2/2 Cr.Misc. No.28604 of 2016 wherein this Court has considered the cases of other similarly situated persons and extended the privilege of anticipatory bail.

In view of such facts and circumstances and that the petitioners also stand similarly placed, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Mohania P.S. Case No.255 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
