The petitioner apprehends his arrest in Aurangabad (Mufassil) P.S. Case No. 63/2016, registered for the offences punishable under Sections 406, 420 of the Indian Penal Code and Section 3, 4 and 5 of the Bihar Mining Act.

The driver of the petitioner was carrying sands on a tractor. The police intercepted the tractor, but the driver managed to flee away. The petitioner was not present at that place. Petitioner is said to be the owner of the tractor. It is submitted that the driver of the petitioner was carrying sand and the petitioner has got no knowledge about this fact.

Considering the facts aforesaid, the petitioner above-

Patna High Court Cr.Misc. No.29915 of 2016 (2) dt.08-09-2016 2/2 named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Mufassil) P.S. Case No. 63/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
