JUSTICE SHIVAJI PANDEY ORAL ORDER 01-11-2017 Heard learned counsel for the petitioner and learned counsel for the State as well as Mid-day Meal. In the present case, petitioner has prayed for a direction to the respondents to allow him for supply of food items and miscellaneous things under the mid-day meal scheme for the period 1.4.2017 to 30.3.2018.
An advertisement was issued for appointment of service provider vide tender no.3 of 2016-17 for supply of food items and miscellaneous things to the schools in the district of Baxar for the period of 1.4.2017 to 31.3.2018. The petitioner has submitted that
Patna High Court CWJC No.3891 of 2017 (3) dt.01-11-2017 the tender along with others but his tender has been rejected on technical ground that in terms of NIT he was required to give an affidavit with regard to his antecedent about blacklisting. He has filed an affidavit but he has not mentioned about the position of the petitioner with respect to blacklisting and on that ground his candidature has been rejected. The petitioner could not point out that he has filed an affidavit properly giving the fact with respect to blacklisting. In such view of the matter, this Court does not find any merit in this writ petition. Accordingly the same is dismissed. (Shivaji Pandey, J) Vinay/- U
