The petitioner seeks bail in Giriyak (Katrisarai) P.S. Case No.357 of 2018 registered under Sections 30, 38 and 41 of the Bihar Prohibition and Excise Act.

The police raided an orchard situated near Mithi Kuan in village Tarabigha and recovered huge quantity of Royal Stag Premier Whiskey and Royal Challenge Classic Whiskey containing 1215 liters. The Choukidar disclosed the name of the petitioner and others and said that he identified the petitioner and others fleeing away.

The learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case. Petitioner has got no concern with the recovered liquor. Similarly situated other accused persons Sandeep Kumar, Shibu Yadav and Chhote

Patna High Court Cr.Misc. No.75713 of 2018(2) dt.18-12-2018 2/2 Singh have already been granted bail.

Considering the aforesaid facts and the fact that the similarly situated accused persons have already been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional District & Sessions Judge-cum-Special Judge, Excise, Nalanda at Biharsharif in connection with Giriyak (Katrisarai) P.S. Case No.357 of 2018(G.R. Case No.4020 of 2018).
