1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109, 352 and 3(5) of the BNS.
3. Learned counsel for the petitioners submits that petitioners have antecedent of one case and are agnates of the informant and in sum and substance, the allegation as alleged in the FIR is that on account of dispute relating to property an altercation had taken place in which the side of the petitioners assaulted the brother of the informant Pradeep Kumar and Dhananjay Kumar by iron pipes, sticks, lathi and rods and even assaulted the informant on account of which his finger of left
Patna High Court CR. MISC. No.51776 of 2025(2) dt.12-08-2025 2/3 hand got fractured and he sustained multiple injuries.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that allegation of assault is general and omnibus in nature i.e. no specific allegation of assault is alleged against the accused persons. It is next submitted that petitioner no. 1 and his wife also sustained injuries and from the side of the petitioners Goshwari P.S. Case No. 168 of 2024 was instituted. It is also submitted that the injury suffered by Dhananjay Kumar and informant is opined to be simple but as far as Dhananjay Kumar is concerned, he is alleged to have suffered four injuries out of which three injures are simple in nature and one injury on wrist is opined to be grievous but then i.e. non-vital part of the body.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like
