JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-08-2022 Though the present writ petition has been filed for removal of encroachment made over the public road appertaining to plot no. 487 situated in village-Amolwa, Thana No. 98, Anchal-Gaunaha, District-West Champaran, crossing through plot nos. 512 (Kabristan), 491, 511 and ultimately joining the main road at plot no. 437, however, the learned counsel for the petitioner has limited his prayer to grant of liberty to the petitioner to approach the Circle Officer, Gaunaha Anchal, District-West Champaran i.e. the respondent no. 5. Liberty so sought is granted.

It is needless to state that in case the petitioner files

Patna High Court CWJC No.3465 of 2021(2) dt.26-08-2022 2/2 appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, before the respondent no. 5 within a period of four weeks from today, the respondent no. 5 shall consider the same and pass appropriate orders thereon in accordance with law, after hearing the affected parties, within a period of 12 weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
