This application for regular bail arises out of Madhepur P.S. Case No. 194 of 2020, disclosing offence punishable under Sections 341, 323, 324, 354(B), 325, 504, 506, 34 of the Indian Penal Code.

The petitioner is under custody since 10.06.2021. The informant has alleged in the F.I.R. that co-accused Dinesh Mukhia had borrowed a sum of Rs. 7000/- (Rupees Seven Thousand Only) and odd which the informant was asking him to repay. In that course, the said Dinesh Mukhia and the petitioner abused her and attempted to outrage her modesty. The persons named in the F.I.R. are also said to have assaulted her causing

Learned counsel appearing on behalf of the petitioner has submitted that the offence is alleged to have been committed on 13.12.2020 for which the F.I.R. has been registered on 16.12.2020 without any valid justification for said delay. He has further submitted that petitioner shall present himself before the Court below as and when required for the purpose of trial if allowed bail by this Court.

Considering the background in which the occurrence is alleged to have taken place, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only), with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Jhanjharpur, Madhubani in Madhepur P.S. Case No. 194 of 2020.
