JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-12-2018 The petitioner seeks regular bail in connection with Muffasil ( Lakhaura ) P.S. Case No. 555 of 2018, registered for offences punishable under Sections 414, 120-B/34 of the Indian Penal Code.

Allegation as per F.I.R. is that police, while patrolling apprehended two persons with motorcycle and on being asked to show the papers of motorcycle, they failed to produce any paper and admitted that they have purchased the motorcycle from one Masti Rai for Rs. 5,000/- and the same is stolen one. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and petitioner is the pillion rider of the said motorcycle and has no knowledge that the motorcycle was stolen one. Patna High Court Cr.Misc. No.71821 of 2018(2) dt.07-12-2018 2/2 antecedent and has been in judicial custody since 06.09.2018. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihar, East Champaran, in connection with Muffasil ( Lakhaura ) P.S. Case No. 555 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
