JUSTICE RAVI RANJAN ORAL ORDER 01-07-2016 I have heard learned counsel for the petitioner, the State and the complainant/informant.

The petitioner apprehends her arrest in a case registered for offences punishable under Sections 420, 406, 308, 385/34 of the Indian Penal Code.

As per the allegation made out in the complaint, the petitioner and her husband alluring the complainant and another for getting employment in Arab country for salary of Rs. 20.000/- and Rs. 5000/- as overtime along with free lodging and fooding, have taken Rs. 1,25,000/- each from two persons, however, they were sent fraudulently to Malaysia and they were given duty of crushing stones. Somehow or the other they escaped from there.

Patna High Court Cr.Misc. No.26170 of 2016 (2) dt.01-07-2016 2/2 Learned counsel for the petitioner submits that the petitioner is lady and her husband has already been taken in custody. It is contended that the petitioner is not involved in any manner in such act.

Considering the fact that the petitioner is lady and coaccused Shamshad Mian has already been taken in custody, let the petitioner, namely, Chand Tara Khatoon be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Barharia P.S. Case No. 248 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, VI, Siwan subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
