JUSTICE SATYAVRAT VERMA ORAL ORDER 27-07-2022 Heard learned counsel for the appellant, learned counsel for the informant and learned Spl. P.P. for the State. Learned counsel for the informant submits that the informant has compromised the case on intervention of wellwishers as such she does not want to pursue the case against the petitioner.
Learned counsel for the appellant submits that a supplementary affidavit has been filed bringing on record the compromise dated 10.05.2022 entered in between the informant and the appellant whereby the case has been compromised. Considering the submissions made by the learned counsel for the appellant and the learned counsel for the informant and also taking into consideration this Court's order
Patna High Court CR. APP (SJ) No.4391 of 2021(3) dt.27-07-2022 2/2 dated 29.06.2022, the impugned order dated 25.09.2021 in A.B.P. No. 6502 of 2021 arising out of Mahila P.S. Case No. 87 of 2021 passed by the learned Additional District & Sessions Judge-III-cum-Special Judge, S.C./S.T. Patna is hereby set aside and the appellant above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mahila P.S. Case No. 87 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. Accordingly the impugned order is set aside and this appeal stands allowed.
