Shailendra Kumar Singh for the Bihar State Food and Civil Supplies Corporation.
The petitioner was granted bail on certain condition vide order dated 15.12.2015 passed in Cr. Misc. No.51765 of 2015 (Annexure-2). Petitioner defaulted in making payment of second instalment and modification application was filed vide Cr. Misc. No. 17408 of 2016 which was disposed of on 27.04.2016 granting extension of time for deposit of second instalment of the amount. There is no dispute that the petitioner deposited the second instalment but beyond the time extended by this Court. The delay is of 14 days. In this background, the application has been filed for
Patna High Court Cr.Misc. No.30818 of 2016 (2) dt.03-08-2016 2/2 modification in the order dated 27.04.2016.
Having heard the parties, I am inclined to allow the application by extending the time for deposit of the second instalment (10 % of the defalcated amount) as directed under order dated 15.12.2015 till 2nd of July, 2016.
Order dated 27.04.2016 passed in Cr. Misc. No. 17408 of 2016 in connection with Chauri P.S. Case No. 21 of 2015 is modified to that extent only.
