====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Excise Case No. 891 of 2018 corresponding to Bhagwanpur P.S. Case No. 180 of 2018, instituted for the offence under Sections 341, 323, 504, 307, 324, 353, 332, 333 of the Indian Penal Code, Sections 37(1)(2) & 30(a) of Bihar Prohibition & Excise Act, 2016. It is alleged that during vehicle checking, police intercepted Motorcycle of the petitioner and recovered one bottle of foreign liquor. It is further alleged that petitioner assaulted the informant and other police personnel. Counsel for the petitioner submits that both sides have sustained injuries. Petitioner is said to be in custody since 8.10.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Kaimur at Bhabua, in connection withExcise Case No. 891 of 2018 corresponding to Bhagwanpur P.S. Case No. 180 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
