The petitioner is in custody in connection with Excise Case No. 384 of 2019 for the offences under Sections 30(K) and 56(Kh) of the Bihar Prohibitiona nd Excise Act, 2018 and Sections 2(E), 3, 5 and 13 of the Bihar Mahua Flower Act, 2007. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 01.07.2019. He further submits that in the instant case 50 Kg. Mahua flower was seized but nothing was recovered from the conscious possession of the petitioner and he has no concern with the seized Mahua flower.

Considering the fact that petitioner has no criminal

No.49713 of 2019(2) dt.09-08-2019 2/2 antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Special Judge, Excise, Gaya in connection with Excise Case No. 384 of 2019.
