The petitioner apprehends his arrest in Karakat P.S. Case No. 196/2013, registered for the offences punishable under Sections 406, 409, 420 and 34 of the Indian Penal Code. The Programme Officer alleged that the petitioner being the Rozgar Sewak issued a cheque of Rs. 8,00,000/- in favour of Sanjay Kumar Singh who purchased a four wheeler from Astha Motors. The money was meant for distribution among the labour under MANREGA scheme.
Learned counsel for the petitioner submits that the money was withdrawn on 11.02.2013. The petitioner filed Karakat P.S. Case No. 35/2013 on 12.02.2013 alleging therein that the cheque and pass-book were misplaced and the same was kept by
Patna High Court Cr.Misc. No.35433 of 2016 (4) dt.08-11-2016 2/2 Nita Devi, Mukhia of Gram Panchayat. The petitioner never put any signature on the cheque, but it appears that petitioner was the custodian of the cheque and he put signature on the cheque only thereafter the money was withdrawn from the Punjab National Bank. The bank official duly verified the signature of the petitioner.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
