The petitioner seeks regular bail in connection with Ahiyapur P.S.Case nO.922 of 2018 dated 30.8.2018 arising out of (G.R.No.5579/18) registered for offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-B)a, 26, 35 of the Arms Act.

Allegation as per FIR is that the police on information of preparing of dacoity raided the place of occurrence and arrested several accused persons including the petitioner and from the possession of the petitioner, one mobile was recovered. Submission of the learned counsel for the petitioner is that nothing incriminating has been recovered from his possession and he has no criminal antecedent and he is in

Patna High Court Cr.Misc. No.71534 of 2018(2) dt.10-12-2018 2/2 custody since 31.8.2018. One of the accused having similar allegation from whom one dagger has been recovered has been granted bail by a Co-ordiante Bench of this Court, vide order dated 4.12.2018 passed in Cr. Msic. No.71379 of 2018. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Muzaffarpur in connection with Ahiyapur P.S.Case NO.922 of 2018 G.R.No.5579 of 2018.

With the aforesaid observation, this application is allowed.
