The petitioner is languishing in custody for the offences punishable under Sections 341, 323, 324 and 376/34 of the Indian Penal Code and Sections 7/8 of the POCSO Act. Allegation against the petitioner is of commission of rape to a minor girl. Petitioner is in custody since 17.01.2019. Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail in connection with Mahnar P.S. Case No. 139 of 2013 pending in the Court of

Patna High Court CR. MISC. No.49443 of 2019(4) dt.21-01-2020 2/2 Special Judge, POCSO cum 1st Additional Sessions Judge, Vaishali.

Prayer for bail of the petitioner is refused. Learned trial Judge is directed to expedite the trial of Mahnar P.S. Case No. 139 of 2013 wherein prosecution evidence is already going on.
