JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-11-2018 The petitioner seeks regular bail in connection with Kuchaikote P.S. Case No. 267 of 2018, registered for offences punishable under Section 30 (a) (b) (c), 38, 41 (a) (b) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 501 liters liquor from the vehicle and petitioner is said to be the driver of the said vehicle, who arrested on the spot.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is only a driver of the said vehicle and the seized articles does not belong to him. Further submission is that the petitioner has not having criminal antecedents and he is in judicial custody for about three months.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned second Additional Sessions Judge-cum-Special Judge, Excise, Gopalganj, in connection with Kuchaikote P.S. Case No. 267 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
