Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Suspicion is against the petitioner and others that since five days prior to the occurrence, they had quarreled with the father of the informant for land dispute, they committed murder of the father of the informant.

Submission is that there is no eyewitness of the occurrence and just to pressurize in the land dispute, false allegation has been levelled.

Considering the fact that there is no direct evidence against the petitioner except suspicion, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.52768 of 2019(2) dt.27-08-2019 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 142 of 2019 arising out of Araria (R.S.) Police Station Case No. 18 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
