JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 25-07-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Amdabad P.S. Case No. 60 of 2016 registered under Sections 341, 323, 325, 504, 324, 307 and 379/34 of the Indian Penal Code. It is contended that a minor scuffle had taken place between the parties as a result of which the instant case has been registered. The nature of injury sustained to the informant would make it evident that no offence as alleged under Section 307 of the Indian Penal Code would be made out.
Learned counsel for the State has opposed the
Patna High Court Cr.Misc. No.28836 of 2016 (2) dt.25-07-2016 2/2 application for grant of pre-arrest bail to the petitioners. Regard being had to the nature of allegation as also that the petitioners have got no criminal antecedent, in the event of arrest or surrender in the court below within six weeks from today, the petitioners, namely, Md. Noorul, Md. Safikul and Md. Tanjir are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Amdabad P.S.Case No.60 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
