The petitioner apprehends her arrest in Dehari (Dalmia Nagar) P.S. case No. 266/2015 under Section 420, 406, 467, 468 of the Indian Penal Code.
The informant alleged that he gave Rs. 15 lacs to Manoj Singh on assurance that he will return the money with interest after business of sands. The informant on different dates invested the money. Manoj Singh gave assurance for payment of money in his account but till date no money is paid. The learned counsel for the petitioner submits that petitioner is the wife of Manoj Singh. The petitioner did not receive any farthing from the informant or any other person. The
Patna High Court Cr.Misc. No.35782 of 2016 (3) dt.27-09-2016 2/2 petitioner has been made accused only because she is one of the directors of M/s Rohit Constructions Pvt. Ltd., which was opened by her husband, Manoj Singh.
Considering the facts aforesaid and the fact that not even a single farthing has been taken by the petitioner on behalf of her husband , the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Dehari -on- Sone, Rohtas, in Dehri (Dalmia Nagar) P.S. Case No. 266 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
