JUSTICE SANJAY PRIYA ORAL ORDER 2/ 28-11-2018 This application has been filed for modification of the order dated 12.10.2018 passed in Cr. Misc. No.63197 of 2018 by which petitioner has been granted bail in connection with Nawanagar P.S. Case No.43 of 2018 to the satisfaction of the Additional Sessions Judge II -cum- Special Judge, Excise Act, Buxar.

Counsel for the petitioner submits that due to inadvertence in the prayer portion of original bail application i.e. Cr. Misc. No.63197 of 2018, name of the Court below has been mentioned as 'Additional Sessions Judge II -cum- Special Judge, Excise Act, Buxar', in place of "Chief Judicial Magistrate, Buxar" and the same mistake has occurred in the order dated 12.10.2018 passed in Cr. Misc. No.63197 of 2018

Patna High Court Cr.Misc. No.69564 of 2018(2) dt.28-11-2018 2/2 by which petitioner has been granted bail.

Counsel for the petitioner is permitted to make necessary correction in the prayer portion of Cr. Misc. No.63197 of 2018 with regard to name of the Court.

Accordingly, in the last paragraph of the order dated 12.10.2018 passed in Cr. Misc. No.63197 of 2018, in place of 'Additional Sessions Judge II -cum- Special Judge, Excise Act, Buxar', it should be read as "Chief Judicial Magistrate, Buxar". The order dated 12.10.2018 passed in Cr. Misc. No.63197 of 2018 is modified to the extent indicated above. This Modification Application is, accordingly, allowed.
